AI-HEART Lab Terms of Service

Effective Date: April 25, 2026

1. Acceptance of Terms

By accessing or using any AI-HEART Labwebsite, application, or service — including the clinical decision support (CDS) calculators and the ARBITER pre-submission review service — you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the services.

For ARBITER, acceptance is confirmed when you check the consent box during account registration. Continued use of the service after any update to these Terms constitutes acceptance of the revised Terms.

2. Intended Users & Eligibility

Clinical Decision Support Tools

The CDS calculators are intended exclusively for licensed healthcare professionals, including physicians, nurse practitioners, physician assistants, and pharmacists. They are not intended for use by patients or the general public.

ARBITER Pre-Submission Review Service

ARBITER is intended for researchers, clinicians, authors, and editors who wish to obtain an AI-generated preliminary peer review of a manuscript. You must be at least 18 years old and must create an account with accurate information to use ARBITER.

3. Clinical Decision Support Disclaimer

  • The CDS software provides clinical decision support based on the following published clinical practice guidelines:
    • 2026 ACC/AHA Guideline on the Management of Dyslipidemia
    • 2025 AHA/ACC Guideline for the Prevention, Detection, Evaluation, and Management of High Blood Pressure in Adults
    • 2023 ACC/AHA/ACCP/HRS Guideline for the Diagnosis and Management of Atrial Fibrillation
    • 2022 AHA/ACC/HFSA Guideline for the Management of Heart Failure
  • All recommendations are derived from published clinical guidelines and must be independently verified by the treating clinician before any clinical action
  • This software does NOT provide medical diagnoses, does NOT replace clinical judgment, and is NOT a substitute for professional medical advice
  • AI-generated content (including extracted data and clinical notes) is produced by large language models and may contain errors, omissions, or hallucinations — clinician review is mandatory before use
  • Shared decision-making tools generate patient-facing handouts intended to facilitate clinician-led therapy discussions and are not intended for independent patient use without clinician involvement

4. FDA Regulatory Status

  • The CDS software meets the criteria for exemption under Section 520(o)(1)(E) of the Federal Food, Drug, and Cosmetic Act
  • It is intended to display, analyze, or print medical information about a patient or other medical information based on peer-reviewed clinical practice guidelines
  • It is intended for use by a qualified healthcare professional
  • It is intended to support, not replace, the clinical judgment of the healthcare professional who independently reviews the basis for the recommendations

5. ARBITER Pre-Submission Review Service

ARBITER is an AI-powered pre-submission manuscript review service that produces structured review feedback. It is designed to assist authors in improving their manuscripts before or during journal submission.

  • ARBITER is not a substitute for formal peer review by a journal or its reviewers
  • ARBITER does not guarantee acceptance at any journal
  • Reviews are generated autonomously by an AI ensemble and are provided as-is, without human editorial oversight
  • AI-HEART Lab, LLC does not act as a reviewer, editor, or co-author of any manuscript processed by ARBITER

6. CANVAS AI Scientific Illustration Service

CANVAS generates publication-quality scientific illustrations (graphical abstracts, mechanism diagrams, study flow diagrams) from manuscript text or abstracts.

  • Generated illustrations are AI-produced and may contain scientific inaccuracies — author review and verification of all visual content is mandatory before publication
  • AI-HEART Lab, LLC does not warrant that illustrations meet the specific formatting or content requirements of any journal or publisher
  • You retain ownership of your uploaded text; generated illustrations are licensed to you for personal and professional use including publication

7. VIGIL Clinical AI Audit Service

VIGIL audits AI-patient conversations and clinical documentation for hallucinations, prompt injection, fabricated references, and safety violations.

  • Audit results are generated by AI and are provided as decision-support aids — they do not constitute a complete or guaranteed assessment of clinical AI safety
  • Organizations are solely responsible for their own clinical AI governance, compliance, and risk management decisions
  • AI-HEART Lab, LLC does not warrant that VIGIL will detect all errors, safety violations, or adversarial content in audited material

8. User Content & Intellectual Property

  • You retain all copyright and intellectual property rights in any manuscript or content you upload to ARBITER
  • By uploading content, you grant AI-HEART Lab, LLC a limited, non-exclusive license solely to process the content for the purpose of generating your review
  • Uploaded manuscripts are automatically deleted from our infrastructure after the review is delivered (see our Privacy Policy for retention details)
  • AI-generated reviews are licensed to you for personal and professional use; you may share, edit, and incorporate them into your work
  • Your manuscripts and review data are never used to train or fine-tune AI models

9. User Representations & Indemnification

By uploading any manuscript or content to ARBITER, you represent and warrant that:

  • You are the author of the manuscript, or you have obtained all necessary rights and permissions to upload the content
  • Uploading the content does not violate any confidentiality agreement, editorial policy, peer-review guideline, or intellectual property right of any third party
  • You have verified that use of AI tools for manuscript review does not violate the policies of any journal, publisher, or institution to which the manuscript has been or will be submitted
  • You are solely responsible for compliance with all applicable journal, publisher, and institutional policies regarding AI usage in peer review and manuscript preparation

You agree to indemnify, defend, and hold harmless AI-HEART Lab, LLC, its officers, employees, and affiliates from and against any claims, damages, losses, or expenses (including reasonable attorney fees) arising from or related to your use of the service, your uploaded content, or your violation of these Terms.

10. Third-Party AI Providers

ARBITER processes manuscripts using multiple AI models, all accessed through HIPAA BAA-covered cloud infrastructure under enterprise agreements with zero data retention.

  • No manuscript data is retained by the underlying AI providers after processing
  • No manuscript data is used for model training by any provider

11. AI Accuracy Disclaimer

  • AI-generated reviews may contain errors, omissions, hallucinated references, or inaccurate assessments
  • ARBITER reviews are preliminary aids and are not a substitute for human expert judgment
  • You are solely responsible for evaluating, editing, and verifying any AI-generated content before relying on it or incorporating it into your work
  • AI-HEART Lab, LLC makes no representation that ARBITER reviews are complete, accurate, or free of bias

12. Subscription, Credits & Payment

  • CDS calculator features are available free of charge on both the website and mobile app
  • Premium CDS features (voice input, AI-assisted extraction, AI note generation, email delivery) require a paid subscription via the mobile app
  • ARBITER provides one free review credit upon registration; additional reviews require purchasing credits
  • Credits are non-refundable once a review has been initiated (manuscript uploaded and processing begun)
  • Unused credits do not expire and remain available on your account
  • AI-HEART Lab, LLC reserves the right to adjust credit pricing at any time; purchased credits retain their value regardless of future price changes

13. Acceptable Use

You agree not to:

  • Upload content that you do not have the right to share, including manuscripts under confidential peer review at a journal that prohibits such use
  • Use the service for any unlawful purpose or in violation of any applicable regulation
  • Attempt to reverse-engineer, decompile, or extract the underlying models, algorithms, or prompts used by the service
  • Abuse the service by submitting automated, scripted, or bulk requests outside normal usage patterns
  • Misrepresent AI-generated reviews as solely human-authored peer reviews when disclosure is required by a journal or institution

14. Limitation of Liability

  • To the maximum extent permitted by law, AI-HEART Lab, LLC's total aggregate liability arising out of or related to your use of the service shall not exceed the total fees paid by you to AI-HEART Lab, LLC during the twelve (12) months preceding the claim
  • In no event shall AI-HEART Lab, LLC, its officers, employees, affiliates, or contributors be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, manuscript rejection, delayed publication, or other intangible losses
  • The user assumes full responsibility for all clinical decisions made using CDS tools and for all editorial decisions made using ARBITER reviews

15. Warranty Disclaimer

The services are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. AI-HEART Lab, LLC does not warrant that the services will be uninterrupted, error-free, or that any defects will be corrected.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least thirty (30) days notice via email or a prominent notice on the service. Continued use of the service after the effective date of any modification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the service.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the services shall be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania, and you consent to the personal jurisdiction of such courts.
